Purpose
These terms and conditions of sale govern the services offered by Julie Pech (trading name BODIY), sole trader, on the website bodiy.fr and during her in-person sessions: group classes, one-off workshops, private classes and corporate classes in prenatal, postnatal, mum-and-baby, kids, happy baby and family yoga.
Provider
Julie Pech (BODIY) — sole trader (see the legal notice).
Services
- Group classes: regular classes in partner studios (Paris, Hauts-de-Seine, Val-d’Oise). Prices, time slots and booking terms are given on the Classes page or by the partner studios.
- Classes and passes sold online: single classes, multi-class passes and yearly or termly enrolments, booked and paid for on bodiy.fr (in particular the classes held at Nest & Bloom), as well as classes by video call. The content, number of classes, times and validity period are shown on each page before payment.
- One-off workshops: themed events (e.g. Mini Morning Club). The price and terms are set out on each workshop page.
- Private classes: on a personalised quote after an exchange (through the Contact form).
- Corporate classes: on a personalised quote.
- Physical goods: the items sold on the Shop page (gift boxes, books). Their price, shipping costs and dispatch time are shown on their page before payment.
Prices and payment
Prices are shown in euros, all taxes included. As a sole trader, Julie Pech benefits from the VAT exemption for small businesses (Article 293 B of the French General Tax Code): VAT not applicable.
Payment is made:
- for workshops, classes, passes and yearly or termly enrolments sold on bodiy.fr: on booking, by online card payment through Stripe Checkout (a secure payment page hosted by Stripe). No card data is processed or stored by bodiy.fr.
- for private and corporate classes: on a quote, upon receipt of the invoice, within 15 days (by bank transfer or by Stripe payment link).
- for physical goods: when ordering, by online card payment through Stripe Checkout. Shipping costs are added to the price of the item and appear as a separate line before payment.
Any late payment gives rise, after a formal notice that has remained without effect, to penalties at the applicable statutory rate and a fixed indemnity of €40 for recovery costs (Article L.441-10 of the French Commercial Code).
Booking a workshop
A booking is confirmed on receipt of payment. Places are allocated in order of booking. If a workshop is full, you can ask to be put on the waiting list.
Cancellation
By the participant
- Group class booked with a partner studio: refer to the studio’s terms.
- Class booked on bodiy.fr (single class, class from a pass or by video call): free cancellation up to 24 hours before the start of the class, by email to julie@bodiy.fr. A single class is then refunded in full; a class taken from a pass is credited back to it. After that deadline, or if you do not attend, the class is due: it is not refunded and remains deducted from the pass.
- Class pass: valid for the period shown on its page, personal and non-transferable. A pass that has been started is not refundable; classes not used by the end of its validity are lost. In the event of a medical contraindication confirmed by a certificate (pregnancy, postpartum), the remaining classes are, at your choice, refunded pro rata to the price paid or transferred to another practice.
- Yearly or termly enrolment: it commits you for the whole period. A missed class is neither refunded nor made up. For a legitimate reason (moving house, a medical reason confirmed by a certificate), the enrolment can be cancelled by email: the classes still to come on the date of the request are refunded pro rata to the price paid.
- One-off workshop: free cancellation up to 48 hours before the start of the event (full refund). After that, the payment is kept. A request to move to a later workshop may be considered case by case.
- Private class: free cancellation up to 24 hours before the appointment. After that, the class is due.
By Julie Pech
If I cancel (illness, family emergency, force majeure), you are told as early as possible by email and you choose between a new date and a full refund of the class or workshop; a class taken from a pass is credited back to it.
Delivery of physical goods
Orders placed on the Shop page are shipped to metropolitan France only. The delivery address is entered on the Stripe payment page; it is not collected by bodiy.fr.
Items are dispatched within the time stated on the product page, from receipt of payment. Shipping costs are those shown before payment. If an item turns out to be unavailable after the order, the order is refunded in full, shipping costs included, within 14 days.
The risk of loss or damage passes to the buyer on receipt of the parcel (Article L.216-4 of the French Consumer Code). A parcel that does not arrive, or arrives damaged, should be reported to julie@bodiy.fr.
Right of withdrawal
Under Article L.221-18 of the French Consumer Code (Code de la consommation), you have 14 days from purchase to exercise your right of withdrawal on a class pass, without having to give a reason. To exercise it, write to julie@bodiy.fr before the period expires; you will be refunded within 14 days. If you asked to use a class from the pass before the end of this period, the amount corresponding to the classes already attended remains due (Article L.221-25).
For physical goods, the 14-day period runs from receipt of the parcel. The item is returned in its original condition, complete, at the buyer’s expense; the price and standard shipping costs are refunded within 14 days of the item being received back.
Exception (Article L.221-28 12°): the right of withdrawal does not apply to leisure services provided on a specific date or for a specific period — a class booked on a time slot, a workshop, a yearly or termly enrolment. The cancellation terms above apply to these services.
Private and corporate classes
A quote is drawn up on the basis of requirements agreed in writing. Signing it constitutes acceptance of these terms and a firm commitment. A deposit of 30% may be requested when ordering corporate services.
Liability
Julie Pech holds professional liability insurance. Practising yoga means listening to your body and respecting its limits. You certify that you are fit to practise yoga (no medical contraindication, prenatal or postnatal follow-up up to date where relevant). If in doubt, ask your healthcare professional for advice.
The publisher cannot be held liable for damage caused by unsuitable practice or by any omission of medical information.
Governing law and disputes
These terms are governed by French law. In the event of a dispute, an amicable solution will be sought first. Failing that, the dispute is brought before the competent court under the ordinary rules; as a consumer, you may bring it before the court of the place where you lived at the time of purchase.
Under Article L.612-1 of the French Consumer Code, you may use a consumer mediation service free of charge (a mediator will be appointed where applicable).
Acceptance
Booking a class, buying a pass or an enrolment, booking a workshop or signing a quote constitutes full and complete acceptance of these terms and conditions of sale.
